1. Scope of Services
- Brunner Lawn & Landscape LLC ("Contractor") agrees to provide weekly lawn maintenance services to the Client at the specified location(s) as agreed upon.
- Service includes mowing, trimming, and blowing grass clippings off driveways, sidewalks, and landscaped beds. Grass clippings will not be bagged or removed from the property.
- Grass will be mowed at a height between 3 and 4 inches unless otherwise requested by the Client. The Contractor will determine the optimal mowing height based on grass type, season, and lawn health.
- The Contractor reserves the right to refuse service if lawn conditions are unsafe or unsuitable due to factors including but not limited to: storm debris, standing water, excessive pet waste, and overfertilization resulting in accelerated grass growth.
2. Service Fees
- The Client agrees to pay the price as stated in the approved estimate, which can be found in their email.
- Prices are subject to change annually and in some cases mid-season due to changes in lawn condition. The Client will be notified of any price increases prior to Contractor completing another service, and a new estimate will be sent for approval before any additional services are performed.
- Payment Terms:
All Clients are required to either:
A. Provide a valid debit or credit card to be kept on file. Cards will be charged on the first day of the following month for any unpaid services rendered. Clients may still pay via cash or check, and payment is due by the first day of the following month to avoid the card being charged.
B. Prepay for services before the first day of the service month. The total amount due will be based on the number of scheduled services for the upcoming month (4 or 5), and payment must be received by the last day of the prior month (e.g., May 31 for June services).
- Prepayment Policy:
If prepayment is not made by the required due date, services will be skipped, and a 50% surcharge will be applied to the next scheduled service.
If prepayment is not received by the 10th of the month of service, the Client will be considered to have canceled services. Their account will be removed from the schedule, and a new estimate will be required to resume services.
- Payment Methods:
Clients may pay invoices via cash, check, or card.
- All estimates, invoices, and receipts are sent via email by default. Paper communications are available upon request.

3. Scheduling and Cancellations
- The Client agrees to provide at least 24 hours' notice for cancellations or rescheduling of services.
- A $10 cancellation fee will be applied for cancellations made within 24 hours of the scheduled service.
- Contractor reserves the right to reschedule services. (See Section 1)
4. Property Access
- Client gives permission for all Contractor personnel to be on the property during Contractor's regular business hours.
- The Client agrees to provide access to the lawn, unlock gates on the expected day of service, and ensure it is clear of any obstacles or hazards prior to service.
5. Client Responsibilities
- The Client agrees to maintain clear communication with the Contractor regarding scheduling, changes, and any issues with the service.
- The Client is responsible for notifying the Contractor of any specific requests or concerns regarding the lawn care.
- The Client agrees to keep the yard clear of toys and any other items that may obstruct the mowing process. Contractor is not liable for damage to property or items left on the lawn.
- Company policy prevents the Contractor from moving trampolines.
- The Client agrees to notify the Contractor in the event of other work that may interfere with the ability to complete the lawn maintenance, such as construction projects or landscaping activities.
- The Client agrees to notify the Contractor if there are utility flags added to the lawn. Areas with an excessive amount of utility flags will be skipped, and Clients will be billed in full. Contractor does not move or trim around utility flags.
6. Skipped Weeks Due to Drought or Heat
- The Contractor reserves the right to skip lawn cutting as needed due to drought or extreme heat conditions that may negatively impact the lawn.
- Clients will NOT be billed for skipped weeks due to drought and/or lack of growth.
- The Contractor will determine when it is necessary to skip a week of lawn cutting for the health of the lawn.
7. Skipped Weeks Due to Flooding
- The Contractor reserves the right to skip lawn cutting if the lawn is inaccessible or unsafe due to flooding conditions.
- The Client is NOT charged for skipped weeks due to flooding. Instead, in such cases, the Client will incur a 50% additional charge on the following service to accommodate for increased time and resources required to handle overgrowth from the skipped week and excessive rain.(In this event, the Client still pays less overall than regular weekly services. Pre-paid customers will receive a statement credit on the following month for any skipped weeks resulting in price decreases.)
- The Contractor will notify the Client of any skipped weeks due to flooding as soon as practicable.
- If a majority of the lawn is servicable, small areas of standing water will be skipped to avoid ruts and damage to the lawn, and Clients will be billed in full. Once dry, skipped areas will be mowed during the next scheduled service.
8. Skipped Weeks Requested by Client
- If a Client requests to skip a week of lawn cutting for any reason, including drought, travel, or any other reason, there will be an additional 50% charge on the following service for added time and resources.
9. Liability
- Contractor will take reasonable care in performing services but is not liable for damages to property or injury unless caused by negligence. Certain areas of lawn (i.e. shaded and/or mossy) are prone to unavoidable wear from tire tread.
- The Client agrees to indemnify and hold harmless the Contractor from any claims, damages, or liabilities arising from the services.
10. Termination of Services
- Either party may terminate services with written notice (email or text).
- Contractor reserves the right to terminate services for non-payment or violation of terms.
11. Governing Law
- This agreement shall be governed by the laws of Michigan.
- Any disputes arising from this agreement shall be resolved through arbitration.
12. Entire Agreement
- This agreement constitutes the entire understanding between the Contractor and the Client and supersedes all prior agreements.
13. Acceptance
- By engaging the services of the Contractor, the Client agrees to these Terms of Service.
